A secondary suite is a separate living space within a main home that has its own kitchen, living area, and a separate entrance. You need a building permit to build a new suite or to legalize one that was built without approval.

Oak Bay’s Secondary Suite Program

After community consultations and studies, Oak Bay created a Secondary Suite Program to regulate both new and existing suites. The program aims to:

  • Be flexible and achievable
  • Support affordable housing
  • Ensure oversight and accountability
  • Respect neighbourhood character
  • Prioritize health and safety for homeowners and tenants

 

Frequently Asked Questions

Secondary suites are permitted in all residential zones that allow single-family homes. If you’re unsure about your property’s zoning, you can:

  • Check Oak Bay’s GIS Mapping Service
  • Contact the Building & Planning Department at planning@oakbay.ca
  • The suite must be inside the main house (not in a detached building)
  • The property owner must live in either the main home or the suite
  • The suite must follow the BC Building Code or approved alternatives
  • Only one suite per home is allowed
  • The home cannot have both a suite and a boarding use (like renting rooms separately)
  • A suite must not be connected to the main house by a breezeway or hallway
  • No extra parking is required, but the home must have an outdoor, labeled, and powered outlet for electric vehicles, scooters, or bikes

A secondary suite is legal when:

  • All building, plumbing, and electrical permits are approved
  • Inspections are completed and passed
  • An Occupancy Permit is issued by Oak Bay

To build or legalize a suite, you need a building permit. The process includes:

  1. Check zoning rules to ensure your home qualifies
  2. Consult a professional (builder, architect) to meet BC Building Code requirements
  3. Submit a Building Permit Application at Municipal Hall (include an Owner’s Declaration Form)
  4. Permit review & inspections by Oak Bay staff
  5. Once everything is approved, an Occupancy Permit is issued
